End-User Licence Agreement (EULA) of Target React Force

PLEASE READ THIS END-USER AGREEMENT (EULA) CAREFULLY. THIS END-USER LICENCE AGREEMENT(EULA) IS A LEGAL AGREEMENT BETWEEN YOU AND INSIDE UNIVERSE IN REGARDS TO TARGET REACT FORCE SOFTWARE, UPDATES, DOWNLOADS INCLUDING FIRMWARE. IT PROVIDES A LICENCE TO USE THE TARGET REACT FORCE SOFTWARE, BY CLICKING “ACCEPT” OR INSTALLING AND/OR USING THE SOFTWARE YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT (EULA).

If you are a Minor or under the age of 18 years old please get an appropriate adult, parent or guardian to read and accept this Agreement for you before you click accept, download, install or use Target React Force. By downloading, clicking accept or installing Target React Force you are accepting the terms of this Agreement and agreeing to the terms set out by this EULA.

This EULA agreement applies to the Software supplied by Inside Universe. The terms also apply to any Target React Force updates, supplements, internet-based services, and the support services for the Software supplied by Inside Universe, unless other terms accompany those items on delivery. If so, those terms apply.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement do not install or use the Software, and you must not accept this EULA agreement.

Inside Universe reserves the right to make modifications to this agreement at a later date. Any future updates to the Software will be accompanied by a “click to accept” agreement and if any future modifications are made to Target React Force software by Inside Universe. To reject the new modifications to this agreement do not click accept and immediately stop using Target React Force Software.

LIMITED LICENCE GRANT

Inside Universe hereby grants you a limited use licence, subject to system requirements, personal, non-transferable, non-exclusive licence to install and use of one copy of the software component(s) of the Software, for your personal use the Target React Force Software on your devices in accordance with the terms of this EULA agreement. Inside Universe reserves the rights to Target React Force, theSoftware is licensed, not sold, for your use. By agreeing to this EULA you are accepting that you have no ownership rights to Target React Force Software, Inside Universe shall at all times retain ownership of the Software as originally downloaded by you and subsequent downloads of the Software by you. The Software, copyright and other intellectual property rights of whatever nature in the Software, including any modifications made thereto are and shall remain solely the property of Inside Universe.

You are permitted to load one copy of the Target React Force Software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the Target React Force software. Inside Universe reserves the right to modify this EULA with additional terms at any time. If you do not consent to the updated terms of this agreement you may not be able to continue using Target React Force Software.

You are NOT permitted to:

Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things.
Reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose.
Exploit the Target React Force Software commercially or cause any damage to the Software.
Allow any third party to use the Software on behalf of or for the benefit of any third party
Copy the Software, in whole or in part, including code, unless the Software itself makes a copy during installation.
Use the Software in any way which breaches any applicable local, national or international law.
Use the Target React Force Software in any multi-user, network or remote access arrangement.
Use of any online use unless part of the Target React Force Software functionality and authorised by Inside Universe.
Combine with, incorporate in or used with any software product other than Target React Force, unless Inside Universe has given permission.
Use the Software for any purpose that Inside Universe considers is a breach of this EULA agreement.
You agree not to use or participate in any of the following:
harassment, abusive, threatening, racially, sexually, harmfull behaviour. You must not adversely affect other players, users, or individuals in a negative way.
Impersonate any person or entity including Inside Universe.
Infringe or violate any intellectual property right.
Violate any applicable law, regulation or treaty.

OWNERSHIP
Inside Universe shall at all times retain ownership of the Software as originally downloaded by you and subsequent downloads of the Software by you. Target React Force Software, copyright and other intellectual property rights of whatever nature in the Software, including any modifications made thereto are and shall remain the property of Inside Universe. All title, ownership rights, and intellectual property rights belong to Inside Universe the Software is protected by Great Britain copyright laws, international copyright treaties, conventions and other laws.

LIMITATION OF DAMAGES
Inside Universe shall not be liable for special, incidental or consequential damages in any form, possession, use or malfunction of the Target React Force Software. Inside Universe shall not be liable for personal injury, loss, financial loss, damage or death. Inside Universe shall not be liable for any injury, loss or damage caused by negligence Inside Universe liability shall not exceed the price paid for the licence to use Target React Force Software.

VIRTUAL REALITY HEADSET WARNING
SPECIAL CARE IS NEEDED WHEN USING A VIRTUAL REALITY HEADSET, PLEASE ENSURE THAT ALL USERS OF TARGET REACT FORCE SOFTWARE READ CAREFULLY THE HEALTH AND SAFETY WARNINGS FROM THE VIRTUAL REALITY HEADSET MANUFACTURER BEFORE USING INSIDE UNIVERSE SOFTWARE TO REDUCE THE RISK OF PERSONAL INJURY DISCOMFORT OR PROPERTY DAMAGE. IN NO EVENT SHALL INSIDE UNIVERSE OR ITS LICENSORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, PERSONAL INJURY OR DAMAGE TO PROPERTY, CONSOLE, COMPUTER OR HANDHELD DEVICE FAILURE, VR HEADSET DAMAGE OR PERSONAL INJURIES.

TERMINATION
This EULA agreement is effective from the date you first use the Software and continue until terminated. You may terminate it at any time upon written notice to Inside Universe at which point you agree to stop all access to and use of the Target React Force Software.

The EULA agreement will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licence granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software.

GOVERNING LAW
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of GREAT BRITAIN.

Target React Force uses Unreal Engine and therefore the user agrees to the terms set out in the Unreal Engine Terms:

Disclaimers and Limitation of Liability

Target React Force includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Inside Universe, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Inside Universe, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Target React Force, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this Target React Force, or will not revoke approval of this Target React Force for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Inside Universe and Epic. Inside Universe, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.

To the maximum extent permitted by applicable law, neither Inside Universe, Epic, Epic’s licensors, nor its or their affiliates, nor any of Inside Universe or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this Agreement, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Inside Universe, Epic, Epic’s licensors, nor its or their affiliates, nor any of Inside Universe or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this Agreement or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Inside Universe, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Inside Universe, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Inside Universe, Epic, Epic’s licensors, its and their affiliates, and any of Inside Universe or Epic’s service providers shall be limited to the full extent permitted by law.
